Modifile sole trader, trading as Modifile (“we”) are committed to protecting and respecting your privacy. “Customer”, “you” or “your” means you as an individual who is the subject of personal data. For the purpose of the Data art. 13 of Legislative Decree no. 196/2003 ("Code regarding the protection of personal data") and subsequent amendments and additions EU 2016/679 (“GDPR”), we process personal data as a data controller and our registered address is Riv. B. Marcello, 7, Venice, Italy.
This policy (together with our Modifile Terms of Use and any other documents referred to on it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

Modifile.com undertakes to collect only information and personal data that are necessary to comply with your requests and / or for other legal purposes or that are voluntarily provided by users through the site and its services.
The processing will be done by means of manual, computerized and telematic tools, however suitable to guarantee the security and confidentiality of your personal data. Your personal data may also be processed by the persons in charge of processing and possibly appointed by Modifile.com.
The provision of personal data is optional. In some cases, however, the provision of your personal data may be mandatory, for the sole purpose of using certain services (eg registration on the site).
Modifile.com does not require the transfer of sensitive data, as defined by art. 4, paragraph 1, lett. D of Legislative Decree 196/2003. We invite you, in any case not to reveal, in the contact form, information that may reveal your racial and ethnic origin, your religious beliefs, philosophical or otherwise, your political opinions, eventual membership of parties, trade unions religious, philosophical, political or trade union associations or organizations, as well as any data or information in any way suitable for revealing your state of health and / or your sexual habits or orientation.
If you have a Modifile.com account, the name of your profile can be viewed by Modifile.com in some of its services, such as the Control Panel.
Information we Collect
To fulfil your order, you must provide with certain information, such as name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information (for a custom order, for example), if you contact me directly.
Why we Need Your Information and How we Use It
We rely on a number of legal bases to collect, use, and share your information, including:
as needed to provide our services, such as when we use your information to fulfil your order, or to provide customer support;
when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list;
if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and
as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services; and 2) Compliance with the Modifile Policy and Terms of Use. I use your information as necessary to comply with my obligations under the Modifile Terms of Use.
Information Sharing and Disclosure
Information about customers is important to our business. We share your personal information for very limited reasons and in limited circumstances, as follows:
Service providers. I engage certain trusted third parties to perform functions and provide services to our shop. We will share your personal information with these third parties, but only to the extent necessary to perform these services.
Business transfers. If we sell or merge our business, we may disclose your information as part of that transaction, only to the extent permitted by law.
Compliance with laws. Data Retention
We retain your personal information only for as long as necessary to provide you with our services and as described in the Privacy Policy. However, we may also be required to retain this information to comply with our legal and regulatory obligations, to resolve disputes, and to enforce our agreements. We generally keep your data for the following time period: 4 years.
Transfers of Personal Information Outside the EU
We may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, we may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If we are deemed to transfer information about you outside of the EU, we rely on Privacy Shield as the legal basis for the transfer, as Google Cloud is Privacy Shield certified.
RIGHTS OF THE INTERESTED PARTY
We remind you that, pursuant to art. 7 of Legislative Decree 196/2003 and EU 2016/679 (“GDPR”), you have the right to obtain:
- confirmation of the existence or not of personal data concerning you, even if not yet registered, and their communication in an intelligible form;
- indications regarding the origin of personal data, the purposes and methods of processing and the logic applied in the case of processing carried out with the aid of electronic tools;
- the identification details of the owner, as well as the subjects or categories of subjects to whom the data may be communicated or who may become aware of it;
- the updating, correction or, if you are interested, the integration of data;
- the cancellation, transformation into anonymous form or blocking of data processed in violation of the Law, including those that do not need to be kept for the purposes for which the data were collected or subsequently processed;
- the attestation that the above operations have been brought to the attention, including as regards their content, to those to whom the data have been communicated and disseminated, except in the case where this fulfillment proves impossible and involves a use of means manifestly disproportionate to the protected right.
- complain. If you reside in the EU and wish to raise a concern about our use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
You also have the right to object, in whole or in part, for legitimate reasons to the processing of personal data, even if pertinent to the purpose of collection, as well as to oppose the processing of personal data for the purpose of sending advertising material or direct sales or for the carrying out market research or commercial communication.
DATA RELATING TO WEB SURFING
In some cases, it is possible the automatic acquisition of information that concerns you, but of a generic nature and that do not allow your personal identification. Examples of this type of information include the type of Internet browser or operating system used and the name of the website domain, or of the advertisement, that linked you to the site, technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, geolocation data.
While viewing the Site, we may store some information in the form of "cookies" or similar files. These files are useful, for example, in order to adapt the Website or an advertisement to the interests and preferences of the user.
